Onboarding and probation: the first 90 days of a UAE hire
Probation in the UAE can last up to six months, yet many employers have no written plan for week four. This guide separates what the law fixes from what the employer chooses.
- Probation may not exceed six months from the start of work, may be used only once with the same employer, and cannot be extended, according to the Decree-Law text and the government portal.
- If the employer ends the contract during probation it must give written notice at least 14 days before the termination date.
- The contract must reach MOHRE within 14 days of the worker's arrival, and the employer may not change the offer's provisions after signing unless the worker consents.
- The law does not set the content of onboarding. Dated milestones are what turn probation into a series of small decisions with evidence behind them.
- Learning research favours testing, spacing and specific feedback over long single sessions, but most of it comes from students and laboratory tasks.
One plan for onboarding and probation
Probation and onboarding are usually treated as separate subjects, one for the contract and one for the first weeks. For the employer they are the same clock. Probation under Federal Decree-Law No. 33 of 2021 is capped at six months from the start of work, and the period counts towards the worker's term of service.[2] If nobody has written down what the new hire should have done by week four, the window can close with an opinion about the person and no evidence.
This guide covers a general UAE hire. Where the role is in real estate, it notes the extra steps that the regulator of Dubai brokerage adds.
What the law fixes
Several steps have set rules, and they run in a sequence. The Decree-Law states that an employer may not recruit or employ a worker without a work permit from the Ministry of Human Resources and Emiratisation (MOHRE), and the government portal adds that it is illegal to work in the UAE without a valid permit.[2][5]
The government portal treats the job offer as the starting document. It must be provided in Arabic and English with a third language the worker understands. Once the worker arrives, both parties sign it and MOHRE registers it as the binding contract, which must state the start date, type of work, workplace, terms, duration and salary and must reach MOHRE within 14 days of arrival or of the change of status. After signing, the employer may not alter or replace the offer's provisions unless the worker consents and the change is within the scope of the law.[3]
On probation itself, the Decree-Law allows no more than six months from the start of work, and no second probation with the same employer. The government portal adds that probation cannot be extended.[1][2] If the employer ends the contract during probation, it must give written notice at least 14 days before the termination date.[2]
The worker has rules too. A worker who wants to move to another employer in the UAE during probation must give the original employer at least one month's written notice, and the new employer compensates the original employer for recruitment costs unless the parties agree otherwise. A foreign worker who wants to leave the UAE must give at least 14 days' written notice. A party that ignores these rules owes wages for the notice period, and a foreign worker who leaves in breach is not granted a work permit for one year.[2]
Pay follows a fixed schedule as well. According to the government portal, under Ministerial Resolution No. 340 of 2026, salaries for the previous month are due on the first day of each Gregorian month through the Wage Protection System.[4] An employer onboarding someone mid-month should know before day one how and when the first payment will be made.
What the law leaves to the employer
None of the sources reviewed sets the content of an induction, the number of check-ins or the standard a new hire must meet. Those are the employer's choices, and the only evidence about them in this guide is general research on learning and the practice of the industry.
The sources also give no basis for saying how many first-year hires leave, or how much structured onboarding changes that. Industry commentary often says that a defined 90-day programme with milestones and a named mentor helps, but this guide found no controlled study to cite, so the 90-day frame below is a convention and not a finding.
Before day one
- Contract. The offer is signed in the required languages, registered with MOHRE and not changed unilaterally afterwards.[3]
- Permit and visa dates. Record the work permit, visa and Emirates ID dates in one place with an owner, so that expiry is seen before it happens.[5]
- Access. Agree which systems the person needs and who grants access. Close access by the same checklist on the day someone leaves.
- A named mentor with protected time, and the first week's schedule.
For a real estate hire in Dubai there are further steps. The Dubai Land Department's practice card page lists a personal photo and a copy of the Emirates ID among the required documents, and its terms require a Dubai Police certificate of good conduct and a pass in the annual test for the mediation profession.[6] RERA's guide sets out the route in four steps: obtain a real estate licence, register it in Trakheesi, submit the card application through Trakheesi and receive the electronic card once fees are settled. It also states that all brokers must download the Dubai REST app.[7] The hire should not advertise, or hold themselves out as a broker, before the card is issued; confirm the position with the Department.
Teaching the first weeks
The research on learning is more useful than most employers expect. Roediger and Karpicke (2006) had students study passages and then either take recall tests or restudy. After five minutes restudying did better, but after two days and a week earlier testing produced substantially greater retention, even though restudying had made students more confident.[8] Cepeda and colleagues synthesised 839 assessments of spaced practice from 317 experiments and found that the best gap between sessions grew with the interval before the final test.[9] A meta-analysis of 435 studies found a medium average effect of feedback (d = 0.48), with large variation depending on the information the feedback carried.[10]
For a new hire this points to short recall questions on the rules of the role in the first weeks, repeated at widening gaps, with specific feedback on real work from the mentor. It argues against one long induction day. The caution is that most of these studies used students and laboratory tasks. The abstracts reviewed report no trials with employees on job-related training, so applying them to a workplace is a judgement and not an established finding.
An outline for 90 days
The outline below is ours and is not a rule. Adapt it to the role.
| When | What is done | A dated check |
|---|---|---|
| Before day one | Contract signed and registered, permits started, access list agreed, mentor named | Owner confirms the list |
| Week 1 | Rules and systems, shadowing, first recall questions | Short quiz on the rules of the role |
| Weeks 2 to 4 | First real work with the mentor listening, feedback twice a week | Week four: first piece of real work done and reviewed |
| Weeks 5 to 8 | Own work, weekly review of records and follow-up | Week eight: a second person reads the work and records |
| Weeks 9 to 12 | Targets set in writing, review of progress against them | Week twelve: a decision with evidence |
Because probation can run to six months and cannot be extended, the dated checks leave room for a decision well before the end. A written note of each check, with the evidence, helps show later why a decision was taken. Whether a particular dismissal is lawful is a question for a labour-law adviser, and this guide does not answer it.
The handoff from recruiting to HR records
The move from applicant to employee is where records are most likely to be duplicated. Integration guidance for applicant and employee systems makes the point that a hire should be matched on a stable identifier before a record is created, so that a rehire, a transfer or a contractor converting to full-time does not become a second person.[11] The same guidance describes at-least-once delivery of hire events, so the receiving system must ignore repeats.[11]
There is a data protection side too. The legal basis for holding the person's data shifts at hire from steps before a contract to employment, and retention rules for the candidate record and the employee record are different. Our guide on candidate data under the UAE data law covers that.
The Works ATS, which The Works Group sells and which is in build, keeps one record for each person with a date on each of nine stages, from identified to joined, and a reason for each exit.[12] What happens after a person has joined, which is most of this guide, sits outside what its product page describes.
